Fire safety in England and Wales runs on the Regulatory Reform (Fire Safety) Order 2005 — the Fire Safety Order. It makes the "responsible person" (usually the employer or whoever controls the premises) legally accountable for fire safety, and it applies to every non-domestic workplace. There is no minimum headcount to hit first.
Part of that duty is appointing enough "competent persons" to help carry out your fire safety measures. In plain terms, that means trained fire marshals — people who can run an evacuation, account for everyone, and hand over to the fire service.
Since October 2023, the rules went further: every business must keep a written, recorded fire risk assessment. It is no longer enough to have done one "in your head." And when a competent assessor writes that document up, one of the actions it almost always lists is "appoint and train fire marshals." This page is how you close that action.
